The justices will soon decide whether to relieve the #Trump admin from the trial court’s order halting the expulsions. Whether the govt has complied w/the order isn’t directly before #SCOTUS. But whether the Court can trust the govt’s representations during such quickly unfolding litigation is—& the justices have every reason not to.

It noted that the #DOJ could sue for breach of contract if it found federal funds were spent while violating *#CivilRights* laws.

The fed govt accounts for ~8% of local #school #funding, but amounts vary. In MS about 23% of school funding comes from federal sources, while NY receives just 7%, acc/to the Pew Research Center.

…Programs [on]…historical events & contributions & promoting awareness would not violate the #law “so long as they do not engage in racial *exclusion* or *discrimination*,” the #Trump admin wrote.

“However, #schools must consider whether any school programming discourages members of all races from attending, either by excluding or discouraging students of a particular race or races, or by creating *hostile* environments based on race for students who do participate,” the #Education Dept said.

In a memo sent to top #PublicEducation ofcls across the country, the #Education Dept said that #funding for schools w/high percentages of #LowIncome #students, known as #TitleI funding, was at risk pending compliance w/the #Trump admin’s directive.

The memo included a *certification* letter that state & local #school ofcls must sign & return within 10 days, even as the admin has struggled to define which programs would violate its *interpretation* of #CivilRights laws.

“#Tariffs are a terrible mistake,” Paul said ahead of the vote. “They don’t work. They will lead to higher #prices.” He added that he believed they were a #tax & “have historically been bad for our #economy.” Paul also argued that the #EmergencyPowers #Trump used to justify the tariffs was an inappropriate circumventing of powers granted to #Congress, not the president.

Sen #RandPaul of Kentucky was the lone #Republican sponsor of the resolution. But 3 other GOP senators who have expressed unease about the potential economic consequences of #Trump’s trade measures joined him in support: #SusanCollins of Maine, #LisaMurkowski of Alaska & #MitchMcConnell of KY.

“The president has justified the imposition of these #tariffs on, in my view, a made-up emergency,” said Senator Tim Kaine, Democrat of Virginia & the lead sponsor of the resolution. “The #fentanyl emergency is from #Mexico & #China. It’s not from #Canada.”

The resolution… seeks to revoke the emergency declaration &, with it, #Trump’s ability to enforce the tariffs set to go into effect on Wednesday.

#Trump imposed the #tariffs in an EO that cited the International Economic Emergency Powers Act, a Cold War-era #law that has most often been used to impose #sanctions on rogue states & human rights violators. His admin claimed that unchecked #DrugTrafficking from #Canada constituted a dire threat to #NationalSecurity & used it as justification to unilaterally impose 25% tariffs on America’s closest trading partner.

The resolution targets the #EmergencyPowers #Trump invoked in Feb to impose sweeping #tariffs on #Canada, a move that has rattled #markets & drawn bipartisan criticism from lawmakers concerned about the economic impact on their states & districts.

“Dismissing the case without prejudice would create the unavoidable perception that the mayor’s freedom depends on his ability to carry out the #immigration enforcement priorities of the administration, & that he might be more beholden to the demands of the federal government than to the wishes of his own constituents,” the judge wrote.

“Everything here smacks of a bargain: dismissal of the indictment in exchange for immigration policy concessions,” Judge Ho wrote. He said he found it “disturbing” that public officials might get special treatment from prosecutors by complying w/ #Trump’s policy goals.
