A federal appeals court in Washington put off for the moment a plan by Judge #Boasberg to open #contempt proceedings to determine whether the #Trump admin violated an order he issued last month stopping flights of #Venezuelan immigrants from being sent to #ElSalvador. The United States Court of Appeals for DC said it was entering what is known as an administrative stay to have more time to consider the validity of Judge Boasberg’s proposal.

Judge #Boasberg cites the #Trump admin’s gloating after his order was violated, noting the “oopsie”tweet from #Bukele & its amplification by admin ofcls.

Boasberg says the admin can “purge” its #contempt by bringing back the people he ordered not to be sent in the first place & giving them appropriate #DueProcess. If not, he will conduct further proceedings.

Boasberg said he’s skeptical of the admin’s invocation of #StateSecrets #privilege.

The Court is exceedingly doubtful that the privilege applies here. It is not inquiring into the diplomatic agreements that facilitated the flights nor the operational specifics of how Defendants apprehended and transported class members. Instead, the Court is simply seeking to confirm times and numbers: how many passengers the two flights carried, whether they were all deported pursuant to the Proclamation, and when they were transferred out of U.S. custody. See Minute Order of Mar. 18, 2:27 p.m. The Court is skeptical that such information rises to the level of a state secret. As noted, the Government has widely publicized details of the flights through social media and official announcements, see supra p. 11 (reposting video showing operational details); ECF No. 69 (Resp. to State Secrets) at 4-10, thereby revealing snippets of 45 the information the Court seeks and raising doubts that such information would jeopardize future diplomatic engagements or operational security.

Judge #Boasberg finds probable cause to hold #Trump admin in #contempt of court for defying his order to turn around planes, demands new details in order for officials to “purge” their contempt.

#Trump dispatches attys like so much legal cannon fodder, to defend the admin’s actions w/little or incorrect information about the underlying facts. It is grudging, if that, on compliance w/court orders, all but inviting judges to find the admin in #contempt of court. Add…Trump’s out-of-court behavior, which has included assailing a respected district-court judge as a “radical left lunatic,” calling for his impeachment, & going after #BigLaw w/blatantly #unconstitutional executive orders.

Text from article(edited for length): Trump... dismissed the scolding by saying Roberts “didn’t mention my name in his statement.” That’s like a 3rd-grade schoolchild getting beaten up & trying to save face by claiming the other guy didn’t lay a glove on him. It can’t thrill Roberts & the Court—who obviously felt strongly that some extraordinary gesture was warranted—to hear that Trump assumes they weren't even addressing him. But Musk’s response was far worse. Yesterday, he made the maximum allowable donations to the 7 Republican members of Congress who have filed or vocally supported the impeachment of the judges. The intent is unmistakable. He is showing contempt for Roberts & the Court, and doing it in his signature crass way—by throwing his money around. He is telling them: Yes, you may have earned the reproach of the highest court in the land, but never fear—you’re doing the right thing, & others should follow suit. This charade with Musk has gone on far too long. If he wants to be a rich benefactor of the administration... let him. But he has no business, and no expertise, to simultaneously run the govt & make radical, slap-happy cuts whose human costs he doesn’t begin to understand. And all this, of course, while the administration is claiming in court that he is some kind of amorphous senior adviser & that DOGE is actually run by a person nobody has heard of—one Amy Gleason—whom we just learned is officially listed on the government rolls as an HHS employee.

…no money was ever received by the family from #Trump. Some of the costs…were covered by the #Army (which offered…to allow Guillén to be buried at #ArlingtonNationalCemetery) & some were covered by donations. Ultimately, Guillén was buried in Houston.

…The personal qualities displayed by Trump in his reaction to the cost of the Guillén funeral—#contempt, #rage, #parsimony, #racism—hardly surprised his inner circle.

The judge loses patience w/ #Blanche, "I'm asking the questions, OK," he says. "Im going to decide whether your client is in #contempt or not, so please don't turn it around." Blanche says in a higher-pitched voice that the prosecutors got as much time as they want.
